ReferenceRabbit is operated by John Amorosso ("we," "us," or "our"), a provider of AI-powered hiring and recruiting tools. Our contact email is john@genesissearch.com.

2. Scope of This Policy

This Policy applies to three categories of individuals: (a) Clients — employers, recruiters, and staffing firms who use ReferenceRabbit to conduct reference checks; (b) References — individuals who call in and are interviewed by the AI agent; and (c) Candidates — job applicants on whose behalf reference checks are conducted.

3. Information We Collect

From Clients:

Name, email address, and contact information provided during account registration.
Billing and payment information (processed by third-party payment processors; we do not store full card details).
Candidate names and reference contact information submitted to initiate reference checks.
Screening questions and other content configured by the Client.
Usage data and activity logs associated with the Client account.

From References (on behalf of Clients):

Phone number used to call in.
Voice recordings of the AI-conducted reference interview.
Automated transcripts and AI-generated summaries of the interview.
Any information the reference voluntarily provides during the call.

About Candidates (provided by Clients):

Name and any identifying information submitted by the Client when initiating a reference check.
Reference check results, which are derived from conversations with the candidate's named references.

Automatically collected:

IP addresses, browser type, device information, and general usage analytics from Client use of our web platform.
Call metadata including date, time, duration, and call status.

4. How We Use Information

We use information to:

Provide, operate, and improve the ReferenceRabbit service.
Generate and deliver reference reports, transcripts, and recordings to the appropriate Client account.
Process payments and manage Client accounts and subscriptions.
Communicate with Clients regarding their accounts, support, and service updates.
Detect and prevent fraud, abuse, or violations of our Terms.
Comply with legal obligations.

We do not use reference interview data for any purpose other than delivering results to the initiating Client and improving AI accuracy in an aggregated, de-identified manner.

5. Data Sharing

We do not sell personal information. We may share information in the following limited circumstances:

Service Providers: Third-party vendors (including telephony providers, cloud infrastructure, and payment processors) who process data on our behalf under confidentiality obligations.
Clients: Reference interview data — including reports, transcripts, and recordings — is shared with the Client who initiated the reference check. Clients are responsible for their own handling of that data.
Legal Requirements: We may disclose information if required by law, subpoena, or court order, or to protect the rights and safety of John Amorosso, our users, or the public.
Business Transfers: In the event of a merger, acquisition, or sale of assets, data may be transferred as part of that transaction.

6. Client Responsibilities Regarding Reference and Candidate Data

Clients act as the data controller for all reference and candidate information collected through their use of ReferenceRabbit. Clients are solely responsible for:

Obtaining written consent from candidates authorizing reference checks on their behalf, as required by the FCRA and applicable state laws.
Informing references that they will be speaking with an AI agent and that the call will be recorded, prior to the call being initiated.
Complying with all applicable privacy, employment, and consumer protection laws governing the collection and use of reference and candidate data in their jurisdiction.
Their own storage, use, and deletion of reports and recordings delivered to them.

7. Data Retention

Client account data is retained for the duration of the subscription or account relationship and for a reasonable period thereafter. Reference call recordings, transcripts, and reports are retained for up to 90 days following delivery, after which they are deleted from our systems. Clients are encouraged to download and store records they wish to retain beyond that period.

8. Security

We implement reasonable administrative, technical, and physical safeguards to protect the information we hold. However, no transmission of data over the internet and no method of storage is completely secure. We cannot guarantee absolute security.

9. Your Rights

Clients may access, update, or request deletion of their account information by contacting us at john@genesissearch.com.

References and Candidates who wish to inquire about data collected through a reference check should contact the employer or recruiter (Client) who initiated the check. We will cooperate with reasonable Client-directed deletion requests.

Residents of certain states (including California under CCPA) may have additional privacy rights. Please contact us to exercise any applicable rights.

10. Cookies and Tracking

Our website uses cookies and similar technologies for basic functionality, session management, and analytics. You may control cookie preferences through your browser settings, though disabling certain cookies may affect platform functionality.

11. Children's Privacy

ReferenceRabbit is intended solely for use in professional employment and recruiting contexts involving adults. We do not knowingly collect personal information from individuals under the age of 18. If you believe a minor has been involved in a reference call through our service, please contact us immediately.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify Clients of material changes by updating the date at the top of this page or by direct communication. Continued use of ReferenceRabbit following any update constitutes acceptance of the revised Policy.
